“Services” include telehealth consultations, follow-up care, treatment plans, and any other offerings provided by Iron Bodies Physiotherapy.

“Client” refers to the individual or their guardian engaging with our services.

Target Audience and Jurisdiction

Eligibility:

Our services cater to individuals experiencing non-urgent musculoskeletal conditions suitable for physiotherapy.

Age Restrictions:

Clients under 18 years of age require the written or verbal consent of a parent or guardian. This individual must:

  • Supervise the minor’s consultations.
  • Agree to these terms on behalf of the minor.

Jurisdictional Limitations:

Iron Bodies Physiotherapy provides services exclusively within Australia. We make no claims or representations that our online physiotherapy services may be lawfully used outside of Australia. If you choose to access or use Iron Bodies Physiotherapy services from outside of Australia, you do so at your own risk and are subject to the judiciary system of Australia.

By engaging our services, you confirm:

  • That you are over 18 years of age, or if under 18, you have parental or guardian consent.

Services Offered

Iron Bodies Physiotherapy provides the following services:

Telehealth Consultations:

  • Standard Consultation: Up to 30 minutes for assessment and treatment planning.
  • Extended Consultation: Up to 60 minutes for comprehensive care.
  • Review Consultation: Up to 20 minutes for follow-up or progress evaluation.

Follow-Up Support:

  • Clients receive one month of secure messaging support following their initial consultation. This period starts on the date of consultation and ends on the same date of the next month.
  • After one month, clients must book a new consultation to continue receiving services.

Service Limitations:

  • Iron Bodies Physiotherapy does not provide emergency medical care.
  • Our services are intended for non-urgent musculoskeletal conditions only.
  • If your condition is deemed unsuitable for physiotherapy, we reserve the right to:
    • Discontinue services.
    • Refer you to an alternative healthcare provider.
    • Offer refunds for unused services, as detailed in the Refund Policy (Section 9).

Client Responsibilities

To ensure effective treatment and compliance with this Agreement, you agree to:

  • Provide accurate medical history and relevant information.
  • Follow treatment plans and advice given by our practitioners.
  • Seek emergency medical care if your condition worsens or becomes urgent.
  • Respect appointment times and cancellation policies.

Payment Terms

Payment Methods:

Payments must be made in full prior to any consultation. We accept major credit cards and debit cards.

Refund Policy

Eligibility for refunds is contingent upon the participant completing their pre-assessment intake form prior to the commencement of their individual session to allow their practitioner to screen for their appropriateness for service prior to commencement of a session. Should this requirement be achieved, refunds will be granted under the following circumstances:

  • If our practitioners determine that physiotherapy is not suitable for your condition prior to or during the initial consultation.
  • Refunds are not provided if you are referred to another healthcare provider after an assessment of a non-urgent condition.
  • Consultation fees are non-refundable once the agreed-upon service has been provided.

Cancellation and Rescheduling Policy

Appointments must be cancelled or rescheduled at least 24 hours in advance to avoid fees.
Late cancellations or no-shows will incur the full consultation fee.

Subscription and Support Policies

Follow-up support via secure messaging is included for one month following your consultation.
Continued support beyond this period requires booking a new consultation.
We reserve the right to terminate follow-up support if you breach this Agreement.

Acceptable Use Policy

By using our messaging service, you agree to communicate in a professional, respectful, and lawful manner. You must not:

  • Engage in harassment, abuse, threats, or hate speech of any kind.
  • Send, share, or request sexually explicit, obscene, or lewd content.
  • Distribute illegal, offensive, or inappropriate material.
  • Impersonate another person or misrepresent your identity.
  • Use the platform for spam, fraud, or unauthorized commercial activities.

Failure to comply with these guidelines may result in message restrictions, account suspension, or termination. We reserve the right to review and take necessary action against any violations.

Privacy and Data Protection

  • In rare cases, information may be shared with other healthcare providers for treatment purposes, with your prior approval.

Risks of Transmission:

While we take every precaution to ensure secure data transmission, there are inherent risks with online communication. By using our services, you accept these risks.

Liability and Disclaimers

  • Statutory Guarantees: Iron Bodies Physiotherapy provides services in compliance with Australian Consumer Law, ensuring they are delivered with due care, skill, and fit for their intended purpose.
  • Exclusion of Liability: To the extent permitted by law, we exclude liability for indirect, incidental, or consequential damages resulting from:
    • Failure to follow treatment plans.
    • Misuse of services.
    • Any technical issues beyond our control.
  • Limitations: Where liability cannot be excluded by law, Iron Bodies Physiotherapy’s total liability for any claim, loss, damage, or expense arising out of or in connection with the provision of services under this Agreement, whether in contract, tort (including negligence), statutory liability, or otherwise, shall be limited to an amount not exceeding AUD $1,000. This cap on liability applies unless otherwise explicitly agreed upon in writing by both parties. This limitation shall apply to the aggregate liability, including any direct, indirect, incidental, consequential, or punitive damages, and any loss of profits, business, goodwill, or data, to the fullest extent permitted by law.

In no event shall Iron Bodies Physiotherapy be liable for any special, incidental, or consequential damages, including but not limited to, any loss or damage resulting from the delay, failure, or performance of the services provided.

Emergency Situations

Iron Bodies Physiotherapy does not provide emergency services. If you experience a medical emergency, contact 000 or seek immediate assistance at the nearest hospital.

Intellectual Property

All materials provided by Iron Bodies Physiotherapy, including but not limited to consultation notes, treatment plans, and follow-up resources, remain our intellectual property. Clients are granted a non-exclusive license to use these materials for personal purposes only. Unauthorized distribution or reproduction is prohibited.

Amendments to Terms and Conditions

Iron Bodies Physiotherapy reserves the right to amend this Agreement at any time. Updates will be published on our website and take effect immediately. Continued use of our services constitutes your acceptance of any changes.

Governing Law and Dispute Resolution

Governing Law:

This Agreement and any dispute or claim (including non-contractual disputes or claims) or controversy arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the laws of Victoria, Australia.

Dispute Resolution:

In the event of any dispute arising out of or relating to this Agreement, the parties shall first attempt to resolve the dispute through good faith negotiations.

Jurisdiction:

Failing the attempt for amicable resolution, the dispute shall be brought before the appropriate court located in Victoria, Australia.

Miscellaneous

Severability:

If any part of this Agreement is found to be invalid or unenforceable, the rest of the Agreement remains in effect, and every provision is valid and enforceable as much as the law allows. Any invalid part will be replaced with a valid provision that best reflects the original intent.

Entire Agreement:

This Agreement contains the entire agreement between the parties with respect to the subject matter of this Agreement. The Agreement supersedes all prior understanding, agreements, or representations, whether oral or in writing.

Force Majeure:

We are not liable for any failure to perform services due to circumstances beyond our control, including natural disasters, technical failures, or regulatory changes.
